1. Acceptance of Terms

By accessing, registering for, and using CostTrack ("the Service"), you agree to be bound by these Terms of Service ("ToS"). If you do not agree to all of the terms and conditions, you are prohibited from using the Service.

2. Service Description & SLA Disclaimer

CostTrack is a financial tracking and document management platform intended for construction and renovation projects.

No Uptime Guarantee: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim any warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or fully secure.

"Lifetime" Deal Definition: Where a "lifetime" payment or fee is offered, this refers solely to the lifetime of the CostTrack software product, not the lifetime of the user. We reserve the right to modify, suspend, or permanently discontinue the Service (e.g., due to unviable third-party API costs) with a minimum of 30 days' notice, without any obligation for refunds.

3. AI Parsing & Extreme Limitation of Liability

Limitation of Liability: To the maximum extent permitted by applicable law, CostTrack, its developers, affiliates, and partners shall NOT be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, tax penalties (e.g., HMRC fines), data loss, project delays, or disputes with builders arising out of or in connection with your use of the Service or reliance on AI-generated outputs.

Liability Cap: In no event shall our aggregate liability for all claims relating to the Service exceed the total amount paid by you to CostTrack during the twelve (12) months immediately preceding the event giving rise to the claim, or £20.00, whichever is greater.

4. Indemnification

You agree to defend, indemnify, and hold harmless CostTrack and its developer(s) from and against any third-party claims, damages, obligations, losses, liabilities, costs, or debt (including but not limited to legal fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these ToS; (c) any dispute between you and your contractors, builders, or tax authorities; or (d) any claim that your uploaded content caused damage to a third party.

5. Usage Limits, Top-Ups & Acceptable Use

The AI document parsing feature and cloud storage are subject to strict usage limits based on your account's billing tier and purchased add-ons.

• Import Tokens & Storage: Once you exhaust your allocated AI import tokens or storage capacity, you will not be able to upload or process further documents until you purchase a respective top-up or upgrade.
• Fair Use: The service is intended for normal, reasonable use associated with construction project tracking. You may not use automated scripts, bots, or scrapers to upload an abnormally high volume of documents.
• Prohibited Data: You may not upload Highly Sensitive Personal Data (e.g., medical records, full credit card numbers) or data entirely unrelated to project tracking.

We reserve the right to rate-limit, throttle, or permanently suspend any account that violates this Acceptable Use Policy or abuses the platform, at our sole discretion.

6. Dormant Accounts & Data Retention

To maintain a fast, affordable service for active users and manage long-term infrastructure costs, we implement a strict dormant account policy.

If your account is completely inactive (defined as no successful logins) for a continuous period of twenty-four (24) months, we reserve the right to permanently delete your account, including all uploaded documents, ledger data, and project configurations, to free up server capacity.

We will attempt to notify you via the email address associated with your account 30 days and 7 days prior to any automated deletion. You can prevent deletion simply by logging into your account.

7. Intellectual Property Rights

Customer Data: You retain all intellectual property rights to the documents and data you upload to the Service.

Service IP: CostTrack retains all right, title, and interest in and to the Service, including all source code, branding, interfaces, and specific proprietary AI parsing methodologies and prompts.
